TIMEOFFAPP Terms & Conditions

 

 

Chapter 1. Definitions

 

For the purposes of these Terms and Conditions, the following definitions shall apply:

Application (App) means the mobile application known as TIMEOFFAPP, including all associated software, services, websites, APIs, updates and related functionality.

User means any natural person who accesses, registers for or uses the Service.

Account means the personal user account created to access the Service.

Service means all features, functionalities, technologies and services made available through TIMEOFFAPP.

OFF Token means the digital reward token distributed through the Application. At the time these Terms are published, the OFF Token has no monetary value and is intended solely as part of the TIMEOFFAPP rewards ecosystem.

Rewards Program means the system through which eligible users may receive OFF Tokens based on their activity and compliance with the rules established by TIMEOFFAPP.

Wallet means a compatible public Polygon blockchain address provided by the User to receive OFF Tokens.

Blockchain means the distributed ledger technology used to record and validate digital asset transactions.

Content means all text, graphics, logos, software, images, interfaces, databases, designs, trademarks and other materials made available through the Service.

Personal Data shall have the meaning assigned under applicable data protection legislation.

Words expressed in the singular include the plural where appropriate, and vice versa.

Chapter 2. Acceptance of these Terms

 

By accessing, downloading, registering for or using TIMEOFFAPP, you acknowledge that you have read, understood and agree to be legally bound by these Terms and Conditions.

If you do not agree with any provision of these Terms, you must immediately discontinue use of the Service.

These Terms constitute a legally binding agreement between you and the developers of TIMEOFFAPP.

Your continued use of the Service following any modification of these Terms constitutes acceptance of the updated version.

TIMEOFFAPP reserves the right to amend these Terms at any time. Material changes may be communicated through the Application or other appropriate means.

Chapter 3. Eligibility

 

The Service is intended exclusively for individuals who are at least eighteen (18) years of age.

By using the Service, you represent and warrant that:

  • you are at least 18 years old;
  • you have legal capacity to enter into binding agreements;
  • the information you provide is accurate and complete;
  • your use of the Service complies with all applicable laws and regulations in your jurisdiction.

TIMEOFFAPP may refuse registration, suspend access or terminate accounts where these requirements are not satisfied.

Certain features or services may not be available in particular countries due to legal, regulatory or technical restrictions.

Chapter 4. User Accounts

 

Users may create an account using an email address and password or through supported authentication providers such as Google Sign-In.

Users agree to:

  • provide accurate, complete and up-to-date information;
  • maintain the security of their login credentials;
  • promptly update any information that becomes inaccurate;
  • notify TIMEOFFAPP immediately of any suspected unauthorized access.

Each individual may maintain only one personal account unless expressly authorized by TIMEOFFAPP.

Creating multiple accounts for the purpose of obtaining additional rewards, bypassing restrictions or manipulating the Service is strictly prohibited.

Users remain responsible for all activities performed through their accounts until such accounts are properly closed.

Chapter 5. Description of the Service

 

TIMEOFFAPP is a digital wellness application designed to encourage healthier smartphone usage habits.

The Service allows eligible users to participate in a rewards programme that may distribute OFF Tokens based on reduced smartphone usage and other criteria established by TIMEOFFAPP.

The Service may include, among other features:

  • account management;
  • usage tracking;
  • identity verification;
  • reward distribution;
  • wallet management;
  • notifications;
  • analytics;
  • customer support.

TIMEOFFAPP continuously improves the Service and may add, modify or remove features at any time without prior notice.

No particular feature or functionality is guaranteed to remain permanently available.

Chapter 6. Rewards Program

 

Participation in the Rewards Program is entirely voluntary.

Eligibility to receive OFF Tokens is determined exclusively by TIMEOFFAPP according to criteria that may include, among other factors:

  • compliance with these Terms;
  • successful identity verification;
  • account status;
  • device integrity;
  • fraud prevention checks;
  • participation requirements;
  • technical limitations.

The methods used to calculate rewards are proprietary and confidential.

TIMEOFFAPP reserves the right to:

  • establish eligibility criteria;
  • modify reward calculations;
  • introduce participation limits;
  • impose daily or monthly caps;
  • reject reward claims;
  • suspend reward distribution;
  • discontinue the Rewards Program at any time.

Participation in the Rewards Program does not create any contractual right to receive future rewards.

TIMEOFFAPP may invalidate rewards obtained through fraudulent or abusive conduct.

Chapter 7. OFF Token

 

The OFF Token is currently distributed solely as a digital reward within the TIMEOFFAPP ecosystem.

At the time these Terms are published:

  • the OFF Token has no monetary value;
  • it is not listed on any cryptocurrency exchange;
  • it is not legal tender;
  • it is not electronic money;
  • it is not a financial instrument;
  • it is not a security;
  • it is not an investment product;
  • it does not represent ownership in TIMEOFFAPP or any related project.

Nothing contained within the Application shall be interpreted as a promise that the OFF Token will obtain market value or liquidity in the future.

TIMEOFFAPP makes no representation regarding future availability, utility, transferability or economic value of the OFF Token.

Future modifications to the token ecosystem may occur without prior notice where permitted by applicable law.

Chapter 8. Wallets and Blockchain

 

Users wishing to receive OFF Tokens must provide a valid Polygon-compatible wallet address.

Users are solely responsible for:

  • selecting a compatible wallet;
  • maintaining control of their wallet;
  • safeguarding private keys and recovery phrases;
  • ensuring that wallet addresses are accurate before submission.

Blockchain transactions are irreversible once confirmed.

TIMEOFFAPP:

  • does not provide custodial wallet services;
  • does not control users’ private keys;
  • cannot recover lost wallets;
  • cannot reverse blockchain transactions;
  • cannot recover tokens sent to an incorrect wallet address provided by the User.

Users acknowledge the technical risks associated with blockchain technology, including network congestion, software bugs, transaction delays and third-party wallet failures.

TIMEOFFAPP shall not be liable for losses arising from blockchain operations beyond its reasonable control.

Chapter 9. Identity Verification (KYC)

 

TIMEOFFAPP may require users to complete an identity verification process before claiming OFF Tokens or accessing certain features. Accepted documents include national identity cards, passports and driving licences where permitted. Verification is performed manually by the development team. Users must provide accurate and up-to-date information. TIMEOFFAPP may request additional information if there are reasonable doubts regarding identity or suspected fraud. Providing false, altered or stolen documents may result in permanent account termination. Verification is intended solely to confirm eligibility, prevent duplicate claims, comply with legal obligations where applicable and protect the integrity of the rewards programme.

Chapter 10. Fraud Prevention

Users agree not to manipulate the Service or the rewards system. Prohibited conduct includes, without limitation: creating multiple accounts; using bots, scripts, automation tools or emulators; falsifying device usage statistics; tampering with operating systems; sharing accounts; using another person’s identity; attempting to manipulate Polygon wallet ownership; exploiting software bugs; or coordinating fraudulent activity with other users. TIMEOFFAPP reserves the right to investigate suspicious activity, suspend rewards, invalidate balances and permanently terminate accounts where fraud is reasonably suspected.

Chapter 11. Suspension and Termination

 

TIMEOFFAPP may suspend or terminate an account immediately where these Terms are breached, fraudulent behaviour is suspected, security is at risk or continued access could harm the Service or other users. Suspension may be temporary while an investigation is carried out. Termination may result in loss of eligibility to receive future rewards. Users may request deletion of their account at any time, subject to applicable legal retention obligations. Records required for fraud prevention, dispute resolution or legal compliance may be retained after account closure.

Chapter 12. Acceptable Use Policy

 

Users must use the application lawfully and in good faith. Users must not reverse engineer, decompile or attempt to access the source code except where permitted by law; interfere with servers or infrastructure; upload malicious software; disrupt the experience of other users; use the Service for unlawful purposes; or exploit vulnerabilities. Commercial use, resale or redistribution of the Service without prior written permission is prohibited.

Chapter 13. Intellectual Property

 

All intellectual property rights relating to TIMEOFFAPP, including software, graphics, branding, logos, interfaces, databases, documentation and other content, are owned by or licensed to the developers. Subject to these Terms, users receive a limited, revocable, non-exclusive and non-transferable licence to use the application for personal, non-commercial purposes only. No ownership rights are transferred to users.

Chapter 14. Open Source Software

 

The application may incorporate open-source software distributed under their respective licences. Nothing in these Terms limits rights granted under those licences. Copyright and licence notices for third-party components remain the property of their respective authors.

Chapter 15. User-Generated Content

 

Where users upload profile images or other permitted content, they confirm that they own the necessary rights or have permission to use such content. Users remain responsible for the legality of uploaded content. TIMEOFFAPP may remove content that is unlawful, infringes third-party rights or violates these Terms. By uploading content, users grant TIMEOFFAPP a limited licence to store, display and process that content solely for operating the Service.

Chapter 16. Privacy and Data Protection

 

TIMEOFFAPP processes personal data in accordance with its Privacy Policy. By using the Service, users acknowledge that certain personal information is required to create an account, verify identity where applicable, distribute OFF Tokens and maintain the security of the platform. Users should read the Privacy Policy, which forms an integral part of these Terms.

Chapter 17. Disclaimers

 

TIMEOFFAPP is provided on an ‘as is’ and ‘as available’ basis. To the maximum extent permitted by law, no warranty is given that the Service will be uninterrupted, error-free, secure, or available at all times. Features, reward rules, algorithms and functionality may change, be suspended or discontinued without prior notice.

Chapter 18. No Financial or Investment Advice

 

Nothing in the Service, its website, documentation or communications constitutes financial, investment, legal, tax or professional advice. OFF Tokens are distributed as part of a rewards programme. Users are solely responsible for evaluating any decision relating to digital assets.

Chapter 19. Taxes

 

Users are solely responsible for determining and complying with any tax obligations arising from receiving, holding, transferring or disposing of OFF Tokens. TIMEOFFAPP does not provide tax advice and is not responsible for reporting or paying taxes on behalf of users unless required by applicable law.

Chapter 20. Limitation of Liability

 

To the fullest extent permitted by law, TIMEOFFAPP and its developers shall not be liable for indirect, incidental, consequential, punitive or special damages, including loss of profits, digital assets, data, reputation or business opportunities. Liability shall also exclude losses arising from incorrect wallet addresses, blockchain congestion, third-party services, user negligence, device failures or events outside TIMEOFFAPP’s reasonable control.

Chapter 21. Indemnification

 

Users agree to indemnify and hold harmless TIMEOFFAPP and its developers against claims, damages, liabilities, costs and expenses arising from misuse of the Service, breach of these Terms, infringement of third-party rights or violation of applicable law.

Chapter 22. Force Majeure

 

TIMEOFFAPP shall not be liable for delays or failures caused by events beyond its reasonable control, including natural disasters, war, civil unrest, cyberattacks, internet outages, failures of blockchain networks, governmental actions, labour disputes, pandemics or failures of third-party infrastructure providers such as cloud hosting services.

 

 

Annexes

 

Annex I – OFF Rewards Program

The OFF Rewards Program is designed to encourage users to reduce unnecessary smartphone usage.

Participation in the Rewards Program is voluntary.

Rewards are calculated according to proprietary criteria established by TIMEOFFAPP.

TIMEOFFAPP reserves the exclusive right to modify, suspend, replace or permanently discontinue the Rewards Program at any time.

The Rewards Program may include, among other factors:

  • Screen time reduction;
  • Daily or weekly activity;
  • Account status;
  • Successful identity verification;
  • Fraud prevention checks;
  • Geographic eligibility;
  • Technical limitations;
  • Campaign-specific rules.

Participation in one reward campaign does not guarantee participation in future campaigns.

TIMEOFFAPP may establish:

  • daily reward limits;
  • monthly reward limits;
  • maximum lifetime rewards;
  • country restrictions;
  • promotional campaigns;
  • bonus events.

The algorithm used to calculate rewards is proprietary and confidential.

TIMEOFFAPP is under no obligation to disclose the calculation methodology.

Annex II – OFF Token Disclaimer

The OFF Token is intended solely as a utility token within the TIMEOFFAPP ecosystem.

At the time these Terms are published:

  • the OFF Token has no monetary value;
  • it is not listed on any cryptocurrency exchange;
  • it does not represent equity;
  • it does not grant voting rights;
  • it is not a financial product;
  • it is not electronic money;
  • it is not a deposit;
  • it is not an investment contract.

Nothing contained in these Terms shall be interpreted as:

  • financial advice;
  • investment advice;
  • an offer of securities;
  • a solicitation to invest;
  • a promise of appreciation;
  • a guarantee of future value.

Future functionality, utility or market value, if any, may depend on factors beyond the control of TIMEOFFAPP.

Annex III – Wallet Responsibilities

Users are solely responsible for:

  • selecting a compatible Polygon wallet;
  • safeguarding their private keys and recovery phrases;
  • ensuring that the wallet address provided is correct;
  • maintaining control of their wallet.

TIMEOFFAPP:

  • does not custody digital assets;
  • cannot recover lost wallets;
  • cannot reset blockchain accounts;
  • cannot reverse blockchain transactions;
  • cannot recover tokens transferred to an incorrect address.

Users acknowledge that blockchain transactions are irreversible.

Annex IV – Identity Verification (KYC)

Identity verification may be requested before rewards are distributed.

Accepted documents may include:

  • National Identity Card;
  • Passport;
  • Driving Licence.

Verification is performed manually.

Users agree to submit authentic, complete and up-to-date documentation.

TIMEOFFAPP reserves the right to reject documentation that:

  • is illegible;
  • appears altered;
  • has expired;
  • belongs to another individual;
  • is otherwise unreliable.

Repeated failed verification attempts may result in suspension or permanent termination of the account.

Annex V – Fraud Prevention Policy

TIMEOFFAPP actively monitors the platform to detect abuse.

Examples of prohibited behaviour include:

  • multiple accounts;
  • identity fraud;
  • fake documents;
  • automated scripts;
  • bots;
  • emulators;
  • rooted or modified devices intended to bypass restrictions;
  • manipulation of usage statistics;
  • reward farming;
  • coordinated fraudulent activity.

Where fraud is reasonably suspected, TIMEOFFAPP may:

  • suspend the account;
  • invalidate pending rewards;
  • permanently remove rewards;
  • permanently terminate the account;
  • refuse future participation.

TIMEOFFAPP reserves the right to investigate suspicious behaviour without prior notice.

Annex VI – Security Recommendations

Users are encouraged to:

  • enable device security features;
  • protect passwords;
  • avoid sharing credentials;
  • verify wallet addresses before submitting them;
  • keep their devices updated;
  • use trusted wallet software;
  • report suspicious activity immediately.

TIMEOFFAPP cannot guarantee protection against risks arising from compromised devices or user negligence.

Annex VII – Third-Party Technologies

TIMEOFFAPP relies on external technologies that may include:

  • Google Firebase;
  • Firebase Authentication;
  • Firebase Analytics;
  • Firebase Storage;
  • Google Sign-In;
  • Polygon blockchain;
  • Google Play services;
  • operating system services.

These providers operate under their own terms and privacy policies.

TIMEOFFAPP is not responsible for interruptions caused by third-party providers.

Annex VIII – Compliance Statement

TIMEOFFAPP is committed to operating transparently and responsibly.

Where applicable, the platform seeks to comply with:

  • the General Data Protection Regulation (GDPR);
  • applicable consumer protection laws;
  • applicable digital services legislation;
  • applicable anti-fraud requirements.

Future regulatory developments relating to blockchain technology, crypto-assets or digital services may require updates to these Terms.

Annex IX – Entire Agreement

These Terms and Conditions, together with the Privacy Policy and any additional policies expressly incorporated by reference, constitute the entire agreement between TIMEOFFAPP and the User regarding the use of the Service.

If any provision is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Failure by TIMEOFFAPP to enforce any provision shall not constitute a waiver of its rights.

Annex X – Legal Glossary

App – The TIMEOFFAPP mobile application.

User – Any individual using the Service.

OFF Token – The digital reward token distributed through the application.

Wallet – A Polygon-compatible public blockchain address.

Blockchain – A distributed ledger technology used to record transactions.

KYC (Know Your Customer) – Manual identity verification process.

Rewards Program – The system through which eligible users may receive OFF Tokens.

GDPR – General Data Protection Regulation (EU) 2016/679.

Force Majeure – Extraordinary events beyond reasonable control that prevent normal performance of contractual obligations.
